Terms of purchase

This English version is provided for information only. In case of any discrepancy, the Spanish version prevails.

1. Purpose

These terms govern the use of Latin Box, a service of Entumood SL (Tax ID B67893578, Carrer Tudo 7, bajo, 43540 La Ràpita, Tarragona, Spain; [email protected]), and the purchase of its subscription plans and credit packs. By signing up and purchasing a plan or a pack, you accept them.

2. Account

You must be of legal age and provide truthful information.
The account is personal and non-transferable: you may not share your access.
You are responsible for keeping your password secret.

3. Plans, credits and prices

Each plan includes a number of credits that are added to your balance at each renewal. Credits you don't spend roll over while your subscription remains active.
Each track has a price in credits, shown before you download it. Downloading again a track you have already downloaded is free.
You can also buy individual credit packs (one-off payment). Credits from packs are added to your balance and follow the same rules as the plan's credits.
Prices include VAT (21%) and are shown before payment. You will receive an invoice for each charge, with your tax ID if you provide it.
The subscription renews automatically each period (monthly or yearly) until you cancel it.

4. Pauses and cancellation

You can pause your subscription up to 2 times. While paused you are not charged, you keep your credits and you cannot download new tracks.
You can cancel at any time from "My subscription". The subscription will remain active until the end of the paid period; at that point it is cancelled and any unspent credits are lost.
No commitment: there is no penalty for cancelling.

5. Right of withdrawal

You have 14 calendar days from your first purchase of a plan to withdraw, by writing to [email protected], provided you have not downloaded any content. As this is digital content, by downloading a track with your express consent you lose the right of withdrawal for that content, in accordance with article 103.m) of Spanish Royal Legislative Decree 1/2007.
The automatic renewals of your subscription are the continuation of the same contract and do not open a new withdrawal period or give the right to a refund. If you don't want it to renew, cancel it from "My subscription" before the renewal date.

6. Music usage licence

Content is downloaded for professional use in DJ sets (live performances, events and similar).
It is not permitted to resell, redistribute, share, upload to other platforms or publish the downloaded files.
The public performance of the works in venues and events is subject to the licences of the relevant collecting societies, which are not Latin Box's responsibility to obtain.

7. Payments

Payments are processed securely through Stripe (card); older subscriptions taken out with PayPal continue to be charged through PayPal. Latin Box does not store your card details. If a charge fails, your subscription will remain pending until you update your payment method.

8. Account suspension

Latin Box may suspend or cancel accounts that breach these terms, in particular for sharing access or redistributing content.

9. Changes to the terms and prices

We may change these terms or the prices. We will notify you in advance, and price changes will apply from your next renewal.

10. Law and jurisdiction

These terms are governed by Spanish law. Any dispute shall be heard by the courts of the consumer's place of residence.

Account security and usage limits

Personal account. Your account is personal and non-transferable and may only be used by the person who purchased the plan. Sharing your login details is not permitted.
Sessions. For security, there can only be one open session at a time on a phone and another on a computer. If you log in on another device of the same type, the previous session is closed.
Download limits. To protect the catalogue, hourly and daily download limits apply (currently, a maximum of 100 different tracks per day and 40 per hour). Downloading again a track you already have does not use credits.
Misuse. If we detect that an account is being shared or used abusively, we may ask you to change your password or suspend or block the account.
Account-sharing warnings. Using the account almost simultaneously from very distant places, or downloading the same track again from a distant place and with a different connection within a short time, counts as a warning. Within a period of 90 days: with the first warning we notify you; with the second the account is blocked for 24 hours and, when you return, you must choose a new password; with the third the account is blocked as a precaution. A member of our team always reviews the block and you can ask us to review it. If it is confirmed that the account has been shared, we may close it, cancelling the subscription, without refund of amounts already paid and with the loss of credits.

Terms for creators

These terms apply to subscribers of the DJ Creator plan who submit their own work to Latin Box through "Upload your track". They are accepted before the first submission and again each time they change.

What can be submitted. Only your own work (mashups, remixes, intros, edits and similar), made entirely by the person submitting it. Material by other people or copied work may not be submitted. If Latin Box finds that a track belongs to someone else or copies their work, it may block the account and cancel any pending or available amounts.
Review. The Latin Box team reviews each submission and freely decides whether to accept it. If accepted, it is published on Latin Box under the creator's name. If not, the reason is given.
Amount. For each track accepted and published, the creator earns the fixed amount corresponding to its type of track, which is shown in the terms assistant and in "My earnings". There is no payment per download or per play. Tracks that are not published do not generate any amount. Latin Box may change the amounts for tracks accepted after the change.
Safety period. Earnings remain pending for 30 days from the track's publication, in case it has to be withdrawn (for rights reasons, because it is a duplicate or due to a claim). If the track is withdrawn for reasons attributable to the creator, that amount is not paid.
Method of payment. After that period, the amount is applied as a discount on the creator's next DJ Creator plan renewal, on the same invoice for that renewal (any amount exceeding one payment is applied to the following renewals). It is not paid in cash or in credits. The discount only exists while the creator keeps the DJ Creator plan: if they cancel their account, cancel the renewal or switch to another plan, they lose any pending and available amounts not yet deducted, with no right to compensation.
Creator's guarantees. By submitting a track, the creator guarantees that they are its author and hold the necessary permissions, that it does not include samples or parts of third-party works without authorisation, and that its publication does not infringe anyone's rights. The creator shall be liable to Latin Box for any claims arising from a breach of this guarantee.
Assignment of rights. Upon acceptance and payment of the track, the creator assigns to Latin Box, exclusively, permanently and worldwide, the exploitation rights they hold over their work in that track (including, among others, reproduction, distribution, public communication, making available and transformation), which includes publishing it, selling it, modifying it and using it for promotion. The creator will continue to be credited as the author of their work.
Leaving. If the creator closes their account or their DJ Creator plan with pending or available amounts, those amounts are lost, as stated in "Method of payment".
Data. We store the date, version, IP address and browser with which these terms are accepted, solely to prove their acceptance and manage the discounts.

Creations with Latin Box AI (Extended + Live)

With the Latin Box AI Extended + Live Creation tool you can make Extended and Live Mashup versions of the tracks you upload.

Authorisation to Latin Box: by exporting a creation, you authorise Latin Box, free of charge, non-exclusively, worldwide and indefinitely, to use it, adapt it (title, cover, data and editing) and publish it in its catalogue as Latin Box content, without mentioning your name.
No payment: this authorisation does not give the right to payment, credits or discounts, and Latin Box will not notify you of each use.
What you upload: you may only upload audio you have the right to use. You are responsible for ensuring the track does not infringe third-party rights; Latin Box may delete anything that does not comply with these terms.
Your use: you can keep using what you export in your sets, just like the rest of Latin Box content.
